Terms of Service
Effective date: July 15, 2026
These Terms of Service (“Terms”) are an agreement between you and Perennial, operated by TJ Middlesworth as a sole proprietor based in Montana(“Perennial,” “we,” “us,” or “our”). By using Perennial, you agree to these Terms. If you don’t agree, please don’t use the service.
Who can use Perennial
You must be at least 18 years old, or the age of majority where you live, to create an account. Coaches and guardians are responsible for any player information they add and confirm they have the authority to share it.
Your account
- Keep your login credentials secure. You’re responsible for activity under your account.
- Provide accurate information and keep it current.
- Tell us promptly at support@perennialteams.com if you suspect unauthorized use.
Acceptable use
You agree not to:
- Break the law or infringe others’ rights while using Perennial.
- Upload harmful code, attempt to breach security, or disrupt the service.
- Access accounts or data that aren’t yours.
- Use Perennial to send spam or harass others.
- Misuse contact information you access through the app. Rosters and guardian contacts are for running your team, not for solicitation.
We may suspend or close accounts that violate these Terms.
Your content
You keep ownership of the content you add to Perennial, such as team details, schedules, and rosters. You grant us a limited license to host, store, and display that content solely to operate the service for you and your team. You’re responsible for the content you add and for having the right to add it.
Plans and payment
Perennial is currently free. We may introduce paid plans in the future. If we do, we’ll present the price and terms before you’re charged, and paid features will be governed by the plan details shown at signup. We’ll give reasonable notice before charging for anything that’s free today.
Text messages (SMS)
If we add text messaging, the following applies to it:
- Consent.You’ll only receive texts from Perennial if you opt in by providing your number and agreeing at the point of signup. Consent to receive texts is not a condition of using Perennial.
- What we send. Team and program messages such as schedule changes, event reminders, RSVPs, and announcements.
- Frequency.Message frequency varies depending on your team’s activity.
- Rates. Message and data rates may apply, depending on your carrier and plan.
- Opting out. Reply STOP to any message to stop receiving texts. Reply HELP for help, or contact support@perennialteams.com.
- Privacy.We won’t share your mobile opt-in or phone number with third parties for their marketing. Carriers are not liable for delayed or undelivered messages.
Third-party services
Perennial relies on third-party services, including Google sign-in and service providers for hosting, data, email, and (if enabled) text messaging. Your use of those features may also be subject to those providers’ terms. We’re not responsible for third-party services.
Service availability
We work to keep Perennial running, but we provide it “as is” and “as available.” We don’t guarantee it will always be uninterrupted or error-free, and we may change, suspend, or discontinue features.
Disclaimers and limitation of liability
To the fullest extent permitted by law, Perennial is provided without warranties of any kind, express or implied. To the fullest extent permitted by law, Perennial and its operator won’t be liable for indirect, incidental, or consequential damages, or for lost data or profits, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us, if any, in the twelve months before the claim.
Indemnification
You agree to indemnify and hold harmless Perennial and its operator from claims arising out of your misuse of the service, your content, or your violation of these Terms or the law.
Termination
You can stop using Perennial anytime and ask us to delete your account. We may suspend or end access if you violate these Terms or if we discontinue the service. Provisions that by their nature should survive termination will survive.
Changes to these Terms
We may update these Terms. If we make meaningful changes, we’ll update the effective date and, where appropriate, notify you in the app or by email. Continuing to use Perennial after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Montana, without regard to its conflict-of-laws rules. Any disputes will be handled in the state or federal courts located in Montana, and you agree to that jurisdiction.
